Pecina’s Mexican Café – Terms & Conditions

1. Introduction & Acceptance of Terms
By dining at, placing an order with, or engaging catering or related services from Pecina’s Mexican Café (“Pecina’s,” “we,” “us,” or “our”), you acknowledge and agree to these Terms and Conditions. These terms govern all transactions, including dine-in, takeout, online orders, catering, and merchandise purchases. By using any of our services, you consent to these terms and any future updates published on Pecinas.com.
2. Products & Services
Pecina’s Mexican Café provides dine-in and takeout meal service, online ordering through Pecinas.com and authorized delivery partners, catering services for private and corporate events, bartending/alcohol service when requested, and the sale of gift cards and branded merchandise. All services are subject to availability and may vary by location.
3. Orders, Payments & Refunds
All orders must be paid in full prior to fulfillment unless otherwise specified in writing. Catering orders require a minimum of forty-eight (48) hours’ notice and may require a deposit at the time of booking. Deposits are non-refundable if cancellation occurs within forty-eight (48) hours of the scheduled service. Pecina’s accepts cash, credit cards, and approved digital payment platforms. Refunds or credits will only be issued at the sole discretion of Pecina’s management in cases of verified service errors or product issues.
4. Catering Policies
All catering services require a minimum of forty-eight (48) hours’ notice. Menu selections, final guest counts, and payment must be confirmed prior to event preparation. Pecina’s provides delivery and setup options within designated service areas. Alcohol catering and bartending services are available for qualifying events, subject to applicable state and local licensing requirements. Pecina’s reserves the right to refuse service or cancel events due to safety, weather, or compliance concerns.
5. Event Liability & Damage Policy
Clients are responsible for any damage to Pecina’s equipment, property, or rental items that occur during an event. Pecina’s is not responsible for lost, stolen, or damaged personal items of guests or clients during service or at any event location.
6. Food Allergies & Dietary Disclaimers
While Pecina’s takes precautions to accommodate dietary needs, we cannot guarantee that any menu item is completely free from allergens such as peanuts, tree nuts, gluten, soy, dairy, shellfish, or other potential allergens. Customers are responsible for disclosing any food allergies or dietary restrictions in advance. Pecina’s assumes no liability for allergic reactions resulting from food consumption.
7. Third-Party Services
Orders placed through third-party platforms (such as delivery apps or online ordering systems) are subject to those platforms’ independent terms, fees, and refund policies. Pecina’s is not responsible for delays, errors, or service issues arising from third-party vendors.
8. Gift Cards & Merchandise
Gift cards are redeemable only for eligible purchases at participating Pecina’s locations. Gift cards are not reloadable, non-transferable, and cannot be exchanged for cash except as required by law. Merchandise sales are final unless defective upon receipt.
9. Limitation of Liability & Indemnification
To the maximum extent permitted by law, Pecina’s Mexican Café shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Customers agree to indemnify and hold harmless Pecina’s, its employees, agents, and affiliates from any claims, damages, or losses resulting from misuse, negligence, or failure to comply with these Terms and Conditions.
10. Privacy & Data Protection
Your use of Pecina’s website, online ordering system, or other digital platforms is also governed by our Privacy Policy available at Pecinas.com. Pecina’s is committed to protecting customer data in accordance with applicable laws and regulations.
11. Termination & Refusal of Service
Pecina’s reserves the right to refuse or cancel any order or service at any time for violations of these terms, non-payment, safety concerns, or inappropriate conduct. Refunds or credits for canceled orders are at the sole discretion of Pecina’s management.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Oklahoma. Venue for any disputes shall be in Oklahoma County, Oklahoma.
13. Acknowledgment & Agreement
By placing an order, scheduling catering, or otherwise engaging Pecina’s Mexican Café, you
acknowledge that you have read, understood, and agreed to these Terms and Conditions. Continued use of our services constitutes your acceptance of any future modifications to this policy.
